Terms of Service/Rules


By commissioning or engaging in an art-related transaction with me (hereby referred to as the artist), you (hereby referred to as the client) agree to all TOS, whether the client read through this entire page or not. Unless stated otherwise, the terms listed here applies to all transactions between the client and the artist.

Note: The abridged form of the artist's TOS is NOT a comprehensive overview of all elements of the actual TOS; it simply reviews the most important elements of the commission process. Please review the full TOS below it for specific details.

ABRIDGED TOS


UPDATED 03/09/23; Clause II
- After being added to the queue, the artist will quote based on the following form:
**a.** Type of art
**b.** Color choice of art
**c.** Quantity of characters
**d.** Detailed references
- Quote payments will be via a Stripe or Paypal invoice in USD after the first WIP is approved by the client
- Failure to pay or respond to the start of the commission after one business week may drop the client from the queue.
- Multiple WIPs will be sent with the goal of making sure that the client has ample opportunity to make appropriate changes at any point during the piece.
- The client and artist may cancel the commission at any time. Client request will be refunded based on % of work completed, whereas artist request will be a full refund.



I. Quote
- The client must remain cordial in communication throughout the commission.
- The client will provide the following information before the artist provides a quote:
**a.** Type of art
**b.** Color choice of art
**c.** Quantity of characters
**d.** Detailed references (at least partially supplemented by visuals; otherwise refer to clause V.)
- The artist will provide a quote based on the listed prices and any applicable surcharges. Listed prices are subject to change at any time, but the quote will not change after it has been confirmed by both parties.
- If the client fails to keep communication, a.k.a "ghosts", the artist for over 6 months without prior notice at any point in the art process, the terms of the commission will be adjusted to account for any new terms/prices.
II. RLC Payment
- Applies to RLC commissions.
- Prices are in USD, but a CAD conversion may be requested at time of the commission.
- The payment will be via a Paypal invoice to [email protected] or [email protected] for USD and CAD invoices respectively. The client will pay a total equal to quoted Price(s).
- Complete payment is required for all commissions worth $200 or less, and may be split in half for the end if over $200.
- The client will send the initial/full payment after the first WIP is approved by the client.
- The client will send payment within a business week unless explicitly discussed with the artist.
III. Non-RLC Payment
- Applies to Non-RLC commissions/transactions, including but not limited to Non-RLC currency, art trades (art-for-art), art trades (art-for-good).
- If the transaction involves Non-RLC currency, policy will follow section 5 and 6 under clause II.
- Exact payment terms for any other transaction will be discussed and approved by both client and artist.
IVa. Full Render Art Process
- The artist is open to questions about the client's place in queue. Allow up to a two week turnover per RLC project once started and a four week turnover per Non-RLC project once started.
- The artist will send an initial sketch for the client's approval; after it is approved, the client will send payment. The client must approve of the pose at this stage; any major anatomical/pose adjustments afterwards will incur a change surcharge. (10% completion)
- The artist will send several more WIPs throughout the commission, at completed linework (33% completion), color flats (33%-66% completion) and rendering. (66%-100% completion)
- The client is limited to 2 rounds of revisions at the end of the sketch, lineart, color flats, and render phase.
- When finished and approved by the client, the artist will email the regular and the watermarked version of the full image file. PNG is default, but the client may request additional file types that are readily available.
IVb. Sketch/Mini Art Process
- The artist is open to questions about the client's place in queue. Allow up to a one week turnover per project once started.
- Character details may be simplified at the artist's discretion.
- The artist will send an initial sketch for the client's approval; after it is approved, the client will send payment. The client must approve of the pose at this stage; there will be no major anatomical changes allowed after.
- The artist will send several more WIPs throughout the commission, at the completed linework and rendering.
- The client is limited to 1 round of revisions at the end of the sketch, lineart, and render phase.
- When finished and approved by the client, the artist will email the regular and the watermarked version of the full image file. PNG is default, but the client may request additional file types that are readily available.
V. Surcharges
- If the commission requires intensive detailing, such as through lace, embroidery, tattooing, etc., refer to the surcharge list below:
**a.** Detailing that requires special attention: *up to +25% surcharge*- If the commission requires custom character design, refer to the surcharge list below:**a.** Commission only has written references: *up to +100% surcharge*
**b.** Commission supplemented with "inspiration" moodboard: *up to +50% surcharge*
**c.** Commission supplemented with specific images for each design element ([example](https://docs.google.com/presentation/d/116M3RFDHmWtzYnVlvQp4ig82uWvkzyaAX7jhDPCoFsA/edit#slide=id.ge163ef9830_0_71)) or existing character reference already: *no surcharge*
- The client has the responsibility to ask for changes to a WIP as early as possible; otherwise, refer to the surcharge list below:**a.** Change requires the artist to redo a combination of linework and color/shading: * up to +50% surcharge*
**b.** Change requires the artist to redo intensive patterning/detailing: *up to +25% surcharge*
VI. Patreon
- In addition to clause VI, clauses I, IV, V also apply to Patreon tier reward type commissions.
**a.** Clause I will be conducted via a Google form that will be opened each month.
**b.** Clause IV communication will be conducted either by email or Discord, up to the client's and artist's discretion.
**c.** Complexities for the tier reward type commissions, such as custom design elements and major revisions will incur additional surcharges via Paypal, as detailed in Clause V.
- The client may not "bank" commissions (stack up their monthly commissions for future redemption)
- The client must submit their commission request (tier reward type) by the twenty-first of the month (CST). The Google form will close afterwards. A reminder will be sent out to those who had not filled out the form by the fourteenth of the month (CST). An exception is granted for those who initially join the tier later in the month.
- The client will not be refunded for the month if they fail to submit their request in time.
- The client may not cancel and rejoin a tier within the month for double benefits.
- The client must submit their commission request (priority type) by the seventh of the month (CST). The Google form will close afterwards.
- The client may only submit one priority commission slot per month.
- Tier commissions will be completed at the artist's discretion throughout the month, while regular commissions through Patreon will follow standard procedure outlined in clauses I and IV.

Client
- May post anywhere, with credit.
- May not make any artistic edits to the commissioned piece unless further commissioned from the artist. Cropping/resizing for the sake of formatting for personal use is permitted, however.
- Unless discussed beforehand or compensated for later on, art is for personal use only, NOT commercial use. Client may not reproduce, print, or use images for the purposes including but not limited to promotion/marketing/contests/products/merchandise.
- May not convert the artwork or design into NFT or any similar concept.
- May not feed my artwork (commissioned or otherwise) into any machine learning or AI based program.
- May not ask for a refund of a completed commission.
- May request a cancellation at any time for any reason. Refund will be based around the % of work completed, if applicable.
Artist
- Reserves the right to post anywhere, with credit.
- Reserves the right to use image for self promotion.
- Reserves the right to turn down any project without reason.
- Reserves the right to discuss pricing for more complex pieces.
- Reserves the right to cancel at any time for any reason. A full refund will be issued, if applicable.


Applicable to personal art commissions only; commercial art commissions are contracted separately.
